livendtv Supreme Court Live Update:-Former Delhi Deputy Chief Minister Manish Sisodia was granted bail by the Supreme Court on Friday morning, almost 18 months after he was arrested by the CBI in an alleged liquor policy case. In several forceful observations, the court said Mr Sisodia deserved a “speedy trial” and sending him back to the trial court would be like playing a “game of snakes and ladders” for him.

A bench of Justices BR Gavai and KV Vishwanathan also said that keeping the Aam Aadmi Party leader in jail for “unlimited time” without trial is a violation of his fundamental rights.
“18 months imprisonment The trial has not even begun and the appellant has been deprived of his right to a speedy trial,” Justice Gavai said while questioning the lower courts.
“Keeping the Appellant behind the bars for an indefinite period would deprive him of a fundamental right. The Appellant has deep roots in the society… There is no possibility of escape. Anyway… conditions can be imposed.” ALSO READ:-https://livendtv.com/delhi-high-court-update-2024/
“The trial court and the High Court should have given due importance to this. The courts have forgotten that bail should not be withheld as a punishment. In principle bail is a rule and jail is an exception…” the court admitted. Said that the long period of imprisonment was unsustainable.
“Bail cannot be rejected as a punishment to (the accused),” the court said. The accused’s right to liberty is “sacred”, the court said, strongly rejecting the trial court’s contention that Mr Sisodia had attempted to delay the trial and therefore should not be released.
The top court also made several critical comments on the federal agencies handling the case, an example of which was Justice Gavai saying, “The names of 493 witnesses were given in this case (and) it is not even remotely likely that Manish Sisodia’s case will be over.” In the (near) future.”
livendtv Supreme Court Live Update Mr Sisodia was arrested by the CBI on February 26, 2023, and by the Enforcement Directorate less than two weeks later. Now that he has been granted bail in both cases, an angry Supreme Court has said that he cannot remain in jail indefinitely while the prosecution is working on a trial date.
The decision was hailed by senior lawyer Abhishek Singhvi as a “very prompt decision”. The response was also surprising; Justice Gavai said, “In a matter of liberty, every day counts….”However, the court has imposed certain conditions on Mr Sisodia, including demanding that he surrender his passport and not visit Chief Minister Arvind Kejriwal’s office. Mr Kejriwal is in jail in the same case and like Mr Sisodia, he has also been arrested by the CBI and ED; In his case, days after his bail was confirmed by the Delhi High Court, he was arrested first by the ED and then by the CBI.
