AAP Rajya Sabha MP Swati Maliwal reached Delhi’s Tis Hazari Court around noon on Friday to record her statement on the assault by chief minister Arvind Kejriwal’s PA Bibhav Kumar. Three days after Swati Maliwal was assaulted by Bibhav at the chief minister’s residence, the MP filed a complaint on Thursday and broke her silence on the issue. “What happened to me was very bad. I have given my statement to the police on the incident that happened to me. I hope that appropriate action will be taken. The last few days have been very difficult for me. I thank those who prayed for me,” Maliwal wrote on X in her first reaction to the incident.
“Those who tried to assassinate my character, said she was doing it on the instructions of the other party, may God keep them happy too,” Maliwal added.
Maliwal will record her statement under Section 164 before a magistrate
The MP was incommunicado for two days after she alleged that she made frantic calls to the cops from Kejriwal’s residence reporting that she was beaten up by the chief minister’s personal assistant. She visited the Civil Lines police station but did not file any official complaint. The party promised to look into her complaints .

In her statement, Maliwal said Bibhav Kumar slapped her, kicked her, used a stick to beat her and then punched her in the stomach and chest.
A medical examination revealed that she had internal injuries to her face.
When all this happened, Kejriwal was present in the house, Maliwal said.

The National Commission for Women on Thursday summoned Bibhav Kumar in connection with the case and asked him to be present at the office on May 17, 11am.
Bibhav Kumar was seen at Lucknow airport on Thursday along with Kejriwal and Sanjay Singh as they were in Lucknow. Kejriwal went to Punjab on Friday for election campaigning.
NCW chairperson Rekha Sharma addressed a press conference on Friday after the deadline for Bibhav’s appearance passed and said if Bibhav did not turn up by Saturday, an NCW team will visit his residence. When the NCW sent its notice to Bibhav, his wife refused to physically accept it and hence the agency pasted it on his door, Rekha Sharma said.
In her statement, Swati Maliwal said: “After that, Bibhav Kumar did not relent and attacked me by kicking me repeatedly in my chest, stomach, and pelvis area with his legs. I was in extreme pain and kept begging him to stop. My shirt was coming up but he still continued to assault me. I repeatedly told him that I am having my periods and that he should please let go of me as I am in unbearable pain. However, he attacked me with full force again and again.” The FIR against Bibhav Kumar was registered under IPC sections 308,341,354B, 506, and 509. Extract From Swati Maliwal’s FIR To Delhi Police
“On 13th May 2024, at around 9 am, I had visited the residence of Mr. Arvind Kejriwal, Chief Minister of Delhi, at 6, Flagstaff Road, Civil Lines, Delhi. Upon arriving, I went inside the camp office and called CM’s PS Bibhav Kumar but I could not get through. I then sent a message on his mobile number (through WhatsApp). However, there was no response. I then went inside the residential area through the main door of the house as I have always done in the past year, since Bibhav Kumar was not present at the camp office.
I entered the residence area and informed the staff present there to tell the CM that I was here to meet him. I was informed that he was present in the house, and I was told to wait in the drawing room. I went in the drawing room and sat on the sofa, waiting for him to meet me. A staff member came and told me that the CM was coming to meet me, and I was asked to wait. Suddenly, the PS of CM, Bibhav Kumar, barged into the room. He started screaming at me without any provocation and even started abusing me. I was stunned by this sudden outburst and I reacted by telling him to stop talking to me like this and to call the CM. He yelled, “तू कैसे हमारी बात नहीं मानेगी? कैसे नहीं मानेगी? … तेरी औकात क्या है कि हमको न कर दे। …। तुझे तो हम सबक सिखायेंगे। [How can you not listen to us? What do you think of yourself? We shall teach you a lesson.]”
While saying these words, he came and stood right in front of me. Without any provocation whatsoever on my side, he started slapping me with full force. He slapped me 7-8 times at least while I continued screaming. I felt absolutely shocked and was screaming for help over and over again. In order to protect myself, I pushed him away with my legs. At that time, he pounced on me, brutally dragged me, and deliberately pulled my shirt up. My shirt buttons opened and the shirt flew up. I landed on the floor while hitting my head on the center table. I was constantly screaming for help but no one came. After that, Bibhav Kumar did not relent and attacked me by kicking me repeatedly in my chest, stomach, and pelvis area with his legs. I was in extreme pain and kept begging him to stop. My shirt was coming up but he still continued to assault me. I repeatedly told him that I am having my periods and that he should please let go of me as I am in unbearable pain. However, he attacked me with full force again and again.
I somehow managed to get free. I then sat on the sofa in the drawing room and gathered my spectacles which had fallen on the ground during the assault. I was in a terrible state of shock at this unexpected attack. I was deeply traumatized and called the 112 number and reported the assault against me. Bibhav threatened me and said, “कर ले जो तुझे करना है। तू हमारा कुछ नहीं बिगाड़ सकती। तेरा हाथ-पैर तुड़वा देंगे और ऐसी जगह गाड़ेंगे किसी को पता भी नहीं चलेगा।” Then, when he realized that I had called the 112 number, he went out of the room. Again, Bibhav came back with the personnel working at the main gate of the CM camp office. They came and asked me to leave at the behest of Bibhav. I kept telling them that I was brutally beaten up and they should look at my condition and wait until the PCR police come. However, they asked me to leave the premises. I was taken outside the CM residence and I sat briefly on the floor outside as I was in deep pain.
The PCR police came but I was completely dazed and left there, walking towards my previous residence in Civil Lines. I was crying and somehow managed to reach my earlier residence. I sat on the ground there for some time and some personnel who had accompanied me from the CM house called me an auto on my behalf. I sat in it and started going towards my house as I was in terrible pain and was traumatized and shattered. Somehow I mustered the strength and asked the auto to stop and went to PS Civil Lines to report the matter. I reached there and sat in the SHO’s office where I was crying and informed the SHO about the incident. I was in terrible pain and having severe cramps. I also started receiving a lot of calls from the media on my mobile. Due to the trauma, pain, and not wanting to politicize the incident, I left the police station without filing a written complaint. My head was splitting in pain and my arms, legs, and chest were aching terribly due to the assault.
The past days since the incident have been extremely painful for me. It is one of the most difficult times of my life. The pain, trauma, and harassment have been mind-numbing. My head and neck have been hurting constantly since the attack. My arms are very sore and my abdomen is also paining. I am also having difficulty in walking. My situation is exacerbated by the fact that having worked all my life for women issues and having helped lacs of women get justice, I ended up being brutally beaten by a person whom I know since long. I am deeply disturbed by this incident and am distraught that someone could display such goonda behavior. I feel totally shattered. It has taken me 3 days to gather myself and report the matter through a written complaint. I request you to kindly take the strongest possible action in the matter. I am shocked that this brutal attack happened to me completely unprovoked at CM residence.
EVM-VVPAT case: A bench of Justices Sanjiv Khanna and Dipankar Datta delivered two concurring verdicts and dismissed all pleas in the matter.
The Supreme Court on Friday, April 26, rejected pleas seeking 100% cross-verification of votes cast using EVMs with a Voter Verifiable Paper Audit Trail (VVPAT) and said “blindly distrusting” any aspect of the system can breed unwarranted scepticism.
A bench of Justices Sanjiv Khanna and Dipankar Datta delivered two concurring verdicts. It dismissed all the pleas in the matter, including those seeking to go back to ballot papers in elections.
An EVM comprises three units – the ballot unit, the control unit and the VVPAT. All three are embedded with microcontrollers with a burnt memory from the manufacturer. Currently, VVPATs are used in five booths per assembly constituency.
EVM VVPAT case: Supreme Court issues two directives
- Justice Khanna directed the Election Commission of India to seal and store units used to load symbols for 45 days after the symbols have been loaded to electronic voting machines in strong rooms.
- The Supreme Court also allowed engineers of the EVM manufacturers to verify the microcontroller of the machines after the declaration of the results at the request of candidates who stood second and third. The top court said the request for the verification of the microcontroller can be made within seven days of the declaration of the results after payment of fees.

The Supreme Court today rejected petitions seeking 100% verification of votes cast on Electronic Voting Machines with paper slips generated through the VVPAT method. The two-judge bench of Justice Sanjiv Khanna and Justice Dipankar Datta delivered concurrent but separate .The Supreme Court, however, passed two directions for the Election Commission. The court said that after symbols are loaded into an EVM, the symbol loading unit should be sealed and secured in containers. The candidates and their representatives shall sign the seal. The sealed containers containing the SLUs shall be kept in the storerooms along with the EVMs at least for 45 days after the declaration of results, the court said.
The court further said that the burnt memory semicontroller in 5% of the EVMs that is the Control Unit, Ballot Unit and the VVPAT per assembly constituency per parliamentary constituency shall be checked and verified by a team of engineers from the manufacturers of the EVM after the announcement of results. This check will be carried out on a written request by candidates 2 and 3. Such a request is to be made within 7 days of the declaration of the results. The cost will be borne by the candidate making the request and expenses must be refunded if the EVMs are found to be tampered
The bunch of petitions before the court had sought a direction to cross-verify every vote cast on EVMs with paper slips generated by the VVPAT system. Currently, this cross-verification is done for five randomly selected EVMs in every Assembly constituency. - The Supreme Court had earlier said it is not the controlling authority for elections and cannot dictate the functioning of the Election Commission, a constitutional authority. It had also wondered if it can act on mere suspicion.
Responding to concerns raised by Advocate Prashant Bhushan, appearing for petitioner Association for Democratic Reforms, the court said in the last hearing, “If you are predisposed about a thought-process, then we cannot help you… we are not here to change your thought process.”In the earlier hearings, the petitioners raised the issue of public trust and drew comparisons with European countries that have gone back to the ballot voting system. The court shot down such comparisons, observing that the challenges here are different. The Election Commission, on its part, stressed that the current system is foolproof.

Who filed the petitions?
- NGO Association for Democratic Reforms, one of the petitioners, had sought to reverse the poll panel’s 2017 decision to replace the transparent glass on VVPAT machines with an opaque glass through which a voter can see the slip only when the light is on for seven seconds.
